About the Project
High Point Uptown Apartments is a luxury residential complex with two apartment buildings encompassing 277 units and a parking garage, plaza, pool, fitness center, and courtyard. The original schedule milestones slipped as construction progressed for various reasons, including weather delays. There were also allegations of construction defects in the completed work, including issues with the load-bearing walls and lateral load-resisting system.
Ultimately, the managing partner of the development team terminated the general contractor when the project had reached approximately 75% completion and retained a replacement general contractor to finish the project. Following the termination of the original general contractor, a dispute arose regarding the final value of the construction contract accounting for work-in-progress, punch list items, and alleged construction defect items.
The legal team retained our team on behalf of the original general contractor to analyze the allegations related to the work-in-progress, punch list items, and construction defects. Our subject matter experts reviewed the conditions of the partially constructed project, reviewed contemporaneous documentation, and performed an analysis of the structural load-bearing wall systems. This work included preparing expert reports and deposition testimony, which was ultimately settled during mediation before trial.
